The money and property of every deceased person in South Africa vests with the Master of the High Court of South Africa. This is known as the winding up of Deceased Estates. If a person dies with a will, their money and property will be distributed in terms of that will. If not, then their money and property will be distributed in terms of the Intestate Succession Act.

 

An Executor is usually nominated in a deceased’s will and assists the Master of the High Court in distributing these funds and attending to all necessary legal processes to ensure the estate is wound up.

Divorce

Divorces are granted by the High Court of South Africa or Regional Magistrate’s Court in the form of a Court Order. While the Court process takes the form of a routine civil litigation matter, special attention must be given to the rights of minor children and separation of estates of partners married in community of property.

Our offices have experience in both divorce litigation as well as the preparation of settlement agreements for settlement out of Court.

If you have a minor child, then a co-parenting plan from the Office of the Family Advocate will be necessary before finalisation of your divorce.
